Don't be confused: it was not a freedom of speech case and today's decision is not at all a free speech decision (I, for one, happen to believe that libelous speech can and should be restricted). The case was about establishing the facts of the matter, and the court decided that there are grounds to claim that the tape depicts a staged event.

I know. And we are talking about France, too, where the libel laws are different from the US.
